헌재 "검수완박법, 국회 표결권 침해"..무효 청구는 기각

"입법과정서 국민의힘 표결권 침해됐지만 가결·선포과정서 위법 없어"

브레이크뉴스 정명훈 기자= 헌법재판소가 지난해 더불어민주당 주도로 국회에서 통과시킨 이른바 '검수완박(검찰 수사권 완전 박탈)'법에 관련, 입법과정에서 국민의힘 의원들의 심의·표결권이 침해당했다고 판단했다. 하지만 해당 법안을 무효로 볼 수도 없다고 결론내렸다.

 

헌재는 23일 오후 서울 대심판정에서 유상범·전주혜 국민의힘 의원이 국회 법제사법위원장을 상대로 낸 권한쟁의심판 청구를 재판관 5대4 의견으로 인용 결정했다.

 

재판부는 "법사위원장은 회의 주재자의 중립적인 지위에서 벗어나 조정위원회에 관해 미리 가결 조건을 만들어 실질적인 조정심사 없이 조정안이 의결되도록 했다"면서 "법사위 전체회의에서도 토론의 기회를 제공하지 않았다"고 밝혔다.

 

이어 "회의 주재자의 중립적 지위와 실질적 토론을 전제로 하는 헌법상 다수결 원칙을 위반했다"고 말했다. 법사위원장이 입법 과정에서 민주당 소속이던 민형배 의원이 위장 탈당했다는 사실을 알고 있음에도 안건조정위원으로 선임했다는 지적이다.

 

헌재는 다만 국민의힘이 검수완박 법안을 가결, 선포한 국회의장을 상대로 낸 권한쟁의는 재판관 5대 4 의견으로 기각했다.

 

이에 대해 재판부는 "청구인들은 모두 본회의에 출석해 법률안 심의·표결에 참여할 권리를 보장받았고, 실제 출석해 개정법률안 및 수정안에 대한 법률안 심의·표결에 참여했다"면서 "국회의장의 가결·선포행위 과정에서 헌법 및 국회법 위반이 없었기 때문에 청구인들의 법률안 심의·표결권을 침해했다고 보기 어렵다"고 설명했다.

 

아울러 "헌법과 국회법에 회기 하한에 관한 규정이 없으므로 짧은 회기라고 해서 위헌·위법한 회기로 볼 수 없다. 적법하게 결정된 회기가 종료돼 무제한토론이 종결됐으므로 무제한토론권한이 침해됐다고 볼 수 없다"고 덧붙였다.

 

헌재는 법사위원장의 가결선포행위에 대한 무효확인청구 역시 재판관 5대4 의견으로 기각했다.

 

한편 민주당은 지난해 6월 검찰이 직접 수사권을 기존 6대 중요범죄(경제·부패·공직자·선거·방위사업·대형참사)에서 부패·경제범죄 등 2개로 축소하고, 수사 개시 검사와 기소 검사를 분리하도록 한 검찰청법·형사소송법 개정안을 주도적으로 입법해 본회의에서 통과시켰다.

 

이에 유상범·전주혜 국민의힘 의원은 민주당 소속의 박광온 당시 법사위원장과 박병석 국회의장이 법사위와 본회의에서 해당 법안들을 가결한 행위는 소수당의 심의·표결권을 침해한 것이라고 주장하며 이 행위가 무효인지도 확인해달라고 헌재에 청구했다.

The Constitutional Court judged that the people's power lawmakers' right to deliberate and vote was violated during the legislative process regarding the so-called "complete deprivation of prosecution investigation" law passed by the National Assembly led by the Democratic Party last year. However, it was concluded that the bill could not be considered invalid.

 

In the afternoon of the 23rd, the Constitutional Court cited the request for a power dispute against the chairman of the National Assembly's Legislation and Judiciary Committee by Yoo Sang-beom and Jeon Joo-hye in a 5-4 opinion.

 

The court said, "The chairman of the judiciary committee deviated from the neutral position of the meeting chairperson and created conditions for the mediation committee in advance so that the mediation plan could be resolved without a practical mediation review."

 

He then said, "It violated the constitutional majority rule that presides over the neutral status of the chairperson of the meeting and the premise of practical discussion." It is pointed out that the chairman of the judiciary committee appointed Min Hyung-bae, a former member of the Democratic Party of Korea, as a member of the agenda coordination committee, even though he knew that he had left the party in disguise during the legislative process.

 

The Constitutional Court, however, dismissed the power dispute filed by the People's Power against the Speaker of the National Assembly, who passed and declared the prosecution's impeachment bill, with a 5-4 opinion by the judge.

 

In response, the court said, "All claimants were guaranteed the right to attend the plenary session to deliberate and vote on the bill, and participated in the deliberation and voting of the revised bill and amendments."

 

In addition, "Since the Constitution and the National Assembly Act do not have regulations on the lower limit of the session, a short session cannot be regarded as an unconstitutional or illegal session. "Since the legally decided session has ended and unlimited discussions have ended, the right to unlimited discussions cannot be considered violated," he added.

 

The Constitutional Court also dismissed the request for confirmation of invalidity of the chairman of the judiciary committee's declaration of approval with a 5-4 opinion of judges.

 

Meanwhile, the Democratic Party of Korea passed a plenary session in June last year by legislating a revision to the Prosecutor's Office Act and Criminal Procedure Act, which required the prosecution to separate prosecutors from prosecutors.

 

Rep. Yoo Sang-beom and Jeon Joo-hye asked the Constitutional Court to confirm whether the act was invalid, claiming that Park Kwang-on, then chairman of the Judiciary Committee, and Park Byung-seok, chairman of the National Assembly, violated the minority party's right to deliberate and vote.
