‘무차별 송금후 거래정지’ 신종 금융사기 횡행

금융소비자연맹, 주의보 발령... 출처 불명 파일-인터넷 주소 삭제해야

금융소비자연맹(이하 금소연, 회장 조연행)은 전자금융 사기범들이 사기피해자의 은행계좌에서 모르는 불특정다수의 계좌에 인터냇송금 방법으로 수십만원의 현금을 입금시킨 후, 고의적으로 ‘금융사기로 신고’를 한 후, 불특정한 수취인의 모든 금융계좌를 정지시키고 연락하여 금융계좌를 해제시켜주는 조건으로 송금액의 몇배의 금전을 편취하는 신종 전자금융사기가 성행하고 있어 긴급 소비자주의보를 발령했다.

 

신종 전자금융사기범들은 이슈가 될 만한 파일이나 문자에 악성 코드를 심어 영상, 메일, SNS 등으로 송신하여 스마트폰이나 컴퓨터에 감염시켜, 인터넷뱅킹에 필요한 개인신용정보를 1차 피해자의 금융정보를 탈취해서, 개인사업자, 중고나라 물품거래자 등 계좌번호를 쉽게 알 수 있는 구매자, 이용자를 속여 계좌번호를 해킹하여 불특정다수인 2차 피해자를 확보한 후 인터넷뱅킹으로 2차 피해자에게 자금을 이체한 후 2차 피해자의 모든 계좌를 ‘지급정지’시키는 신종 수법이다.

 

이들은 모든 금융계좌가 지급정지되어 금융거래에 커다란 어려움을 겪고 있는 2차 피해자들에게 접근하여, 1차 피해자 계좌로부터 받은 돈을 물론 수십 배의 금전을 요구하여 협박과 강압 등으로 돈을 받아내는 신종 수법을 쓰고 있다.  

 

금소연은 출처가 불분명한 파일을 다운받거나 의심스러운 인터넷 주소가 포함된 문자를 누르면 악성 코드에 감면될 수 있어 삭제하고, 오픈뱅킹 가입절차를 까다롭게 하고 인터넷뱅킹을 사용할 때 보안카드, 간편 비밀번호보다는 1회용 비밀번호 생성기기 OTP를 사용하는 것이 안전하며, 출처를 모르는 착오입금은 임의로 송금해서는 안 되며 금융사의 반환절차에 따라야 한다고 소비자주의보를 발령했다.

 

1차피해자인 송금 명의인은 본인도 모르게 돈이 사라지는 금전적인 피해를 보고, 2차 피해자인 수취인은 금융권 전 계좌가 지급정지 되어 송금이나 자금을 인출할 수 없어, 대출이자, 신용카드이용대금, 통신·전기·가스요금 등 공과금 등이 자동이체가 안 되어 금융거래의 불편, 신용 악화 등의 불이익을 당하고, 1차피해자와 공범으로 의심을 받으며, 자칫하면 금융거래질서문란자로 몰려 10년간 금융거래 제재를 받을 수도 있다. 

 

신종전자금융 사기범들은 2차피해자들에게 연락하여 착오송금, 감언이설, 협박 등으로 알려준 계좌번호로 송금을 요구한다.

 

하지만 이들의 요구를 그대로 따를 경우, 자칫하면 선의라 하여도 1차 사기 피해자에 대한 횡령죄가 성립될 수 있으며, 1차 피해자가 전기통신금융사기 신고를 하면 사기 방조, 자금세탁 등 더 큰 곤욕을 치를 수 있다.

 

2차피해자인 수취인이 사기 금액이 입금되었다며 경찰에 신고한 후 1차 피해자가 전기통신금융사기 신고로 쌍방 피해자가 경찰서에 출석하여 합의하여도, 금융사는 수취인이 ‘혐의없음’이라는 경찰서의 결정 통보를 받기 전에는 지급정지 해제를 하지 않는다.

 

신종 전자금융 사기범들이 2차피해자인 수취인 전 계좌의 지급정지를 악용하여, 1차피해자의 자금을 소액으로 나누어 송금하고 금융사에 전기통신금융사기 신고로 지급 정지된 후 해제 조건으로 웃돈을 요구할 경우, 금융거래의 불편과 신용상의 불이익을 염려하여 쉽게 송금해서는 절대로 안 된다.

 

‘송금한다’ 하여도 사기범이 해제할 의사도 없으며 금융사나 경찰서에 출석하여 서면으로 해제 신청하거나 사건신고를 할 리 만무한데다 1차 피해자가 신고하기 때문이다.

 

전기통신금융사기 피해자가 금융사에 지급정지 신청을 하면, 즉시 수취인의 계좌가 지급정지되며 피해자는 경찰서에 신고하고 ‘사건사고사실확인원’을 발급받아 금융사에 제출해야 한다.

 

하지만, 수취인은 금융거래의 지장으로 하루라도 빨리 금융거래를 하고 싶어 금융사, 수사기관에 방문하여 “전기통신금융 사기범과는 무관하고 나도 피해자다”, “피해자에게 송금한 돈을 돌려주고 지급정지를 해제해 달라”고 요청하여도 수사기관이 사실관계를 수사 확인하는 데는 짧게는 보름 늦게는 수개월 소요된다.

2014년 전기통신금융사기 피해방지 및 피해금 환금에 관한 특별법이 제정되어 사기범들이 빠른 시간 안에 많은 범죄수익금을 인출하지 못하게 만든 제도가 있다.

 

신속한 지급정지로 1차피해자인 송금인의 피해를 줄일 수 있는 반면에 선의의 2차 피해자에게는 금융거래의 불편, 신용상의 불이익이 크므로 전 계좌의 지급정지보다 신고 해당 금원을 지급정지하고 금융거래를 할 수 있도록 하는 제도 개선이 필요하다.

 

금융소비자연맹 강형구 사무처장은 “금융사는 금융소비자가 안심하고 금융거래를 할 수 있도록 해야 하나, 신종 전자금융사기에 대해서 신속하게 대처하지 못하는 게 현실이다”며, “비대면 거래 본인 확인은 본인이 아니면 할 수 없도록 확인 절차를 강화하고, 외부 공권력에 의존보다 내부 기준을 마련하여 선의의 피해자가 발생하지 않도록 해야 한다”고 말했다.

 

전기통신금융사기를 당할 경우, 금융소비자연맹과 한국금융범죄예방연구소에서 신종전기통신금융 피해 상담을 접수해 대처방법을 상담해 준다.
