브레이크뉴스 박동제 기자= 배우 장근석의 모친이 수십억원대 탈세 혐의로 1심서 징역형 집행유예를 선고받았다.
19일 서울중앙지법 형사합의25-3부(부장판사 권성수·김선희·임정엽)는 특정범죄 가중처벌 등에 관한 법률 위반(조세) 등 혐의로 기소된 장근석 모친 전모(61)씨에게 징역 2년 6개월에 집행유예 4년, 벌금 30억원을 선고했다.
재판부는 “피고인 전모 씨는 단순 신고 누락을 넘어 법인장부에 전혀 기재하지 않았고, 세무조사시 사후 수정 신고를 하거나 증빙서류를 제출하지 않았다. 세무조사 후에도 총 18억원이 넘는 세금을 포탈하는 등 범행 방법이나 결과에 비춰봐도 비난 가능성이 크다”고 밝혔다.
이어 재판부는 “다만 전모 씨가 환율 변동 및 인플레이션 위험을 회피하면서 지속적으로 돈을 보관하려는 의사로 보이고, 개인적으로 유용하기 위한 것이었는지 단정하기 어렵다”며 “피고인이 현재는 포탈한 세액을 전부 납부한 상태고, 같은 유형의 범죄로 처벌받은 전력이 없는 점을 유리한 정상으로 참작한다”고 덧붙였다.
양벌규정에 따라 조세범 처벌법 위반 등 혐의로 함께 기소된 트리제이컴퍼니(변경 후 봄봄)는 벌금 15억원을 선고받았다.
전모 씨는 아들 장근석이 그동안 해외 활동을 통해 벌어들인 수입을 홍콩 등 다른 나라의 계좌로 인출, 사용하는 방식으로 수십억원대의 소득 신고를 누락해 탈세한 혐의로 재판에 넘겨졌다.
한편, 장근석은 양극성장애(조울증)로 4급 판정을 받고 지난 2018년 7월부터 사회복무요원(공익)으로 대체복무 했으며, 지난해 5월 소집해제 됐다. 장근석은 트리제이컴퍼니의 세무조사 사안을 계기로 가족경영에 대한 심각한 문제를 인지하고 군 입대와 동시에 독립했다.
