브레이크뉴스 정명훈 기자= 다스(DAS) 실소유 의혹과 관련한 비자금 횡령 및 삼성 뇌물 혐의로 재판에 넘겨진 이명박(78) 전 대통령이 대법원에서 징역 17년을 확정받았다.
대법원 2부(주심 박상옥 대법관)는 29일 특정범죄 가중처벌법상 뇌물 등 혐의로 기소된 이 전 대통령의 상고심에서 징역 17년에 벌금 130억원을 선고한 원심을 확정했다.
재판부는 "횡령 및 뇌물수수의 사실인정과 관련한 원심 결론에 잘못이 없다"며 이 전 대통령측과 검사의 상고를 모두 기각했다.
이는 1~2심 재판부와 마찬가지로 다스의 실소유주를 사실상 이 전 대통령이라고 인정한 것이다.
재판부는 이 전 대통령이 법원의 보석 취소 결정에 불복해 재항고한 사건도 기각했다. 이에 따라 구속집행정지 상태였던 이 전 대통령은 조만간 다시 수감될 전망이다. 통상의 관례대로라면 2~3일간 신변 정리 시간을 준 뒤 기결수 신분으로 수감된다.

1심 재판부는 "이 전 대통령이 다스의 실소유자이고 비자금 조성을 지시한 사실이 인정된다"며 "대통령 선거기간 내내 다스 의혹이 제기됐음에도 당선될 수 있었던 까닭은 결백을 주장한 이 전 대통령을 말을 믿어준 다수의 국민들이 있었기 때문"이라고 말했다.
이어 "재임 시절 저지른 다른 범행들이 함께 드러남으로써 당시 이 전 대통령을 믿고 지지하였던 국민들은 물론 우리 사회 전반에 큰 실망과 불신을 안겨줬다"며 징역 15년에 벌금 130억원을 선고하고, 추징금 82억원을 명령했다.
또 삼성이 다스의 소송비를 대납했다는 혐의와 관련해서는 61억8000만원의 뇌물 액수를 인정했다. 이후 검찰은 공소장을 변경해 삼성의 소송비 대납과 관련, 51억원의 뇌물 액수를 추가로 인정해달라고 요청했다.
2심 재판부는 "뇌물죄가 인정되지만 적극적으로 요구한 것으로 보이지 않는다"면서 "대통령으로서 본인이 뇌물을 받지 않는 것은 물론이고, 공무원이 부정한 이익을 취해 국가가 부패하는 것을 막아야 할 의무가 있었다"고 했다.
또 삼성의 소송비 대납 관련 뇌물 액수를 89억원에 이르는 것으로 보는 등 뇌물액을 추가로 인정하며 1심보다 높은 형량을 선고했다.
2심은 "지난 2009년 이건희 삼성그룹 회장에 대한 특별 사면과 관련해 삼성이 다스의 미국 소송 비용을 대납했다는 사정에서 대통령의 헌법상 권한인 특별 사면권이 공정하게 행사되지 않았다는 의심을 받게 됐다"며 징역 17년에 벌금 130억을 선고했다. 57억8000여만원의 추징금도 명령됐다.
