김웅 전 의원의 ‘cheap talk’ 게임

김웅 전 의원은 비겁하다. 그는 자신의 페이스북을 이용해 ‘cheap talk’ 게임을 벌이고 있다. 게임이론에는 'Cheap Talk(값싼 말)'라는 개념이 있다. 말 그대로 비용이 들지 않는 말이다. 책임도 없고, 구속력도 없으며, 사실인지 거짓인지 즉시 검증하기도 어렵다. 그래서 Cheap Talk는 정보를 전달할 수도 있지만, 반대로 사람들의 추측과 혼란만 키울 수도 있다. 김웅 전 의원의 최근 페이스북 메시지가 바로 그렇다.

 

그는 2019년 검경수사권 조정 과정에서 민주당과 검찰 사이에 "악마적 거래"가 있었다고 주장했다. 그 거래를 했던 사람이 지금은 보완수사권 존치를 외친다고도 했다. "모든 게 가짜인 인간"이라는 독한 표현도 서슴지 않았다. 그런데 정작 가장 중요한 것은 끝내 말하지 않았다. 도대체 누구인가.

 

이런 방식은 전형적인 Cheap Talk. 자극적인 메시지는 던지지만 가장 중요한 정보는 숨긴다. 실명을 밝히지 않으니 법적 책임도 줄어들고, 상대방도 반론하기 어렵다. 반면 독자들은 단서를 조합하며 여러 사람을 의심하기 시작한다. 정치적 관심은 얻으면서도 책임은 최소화하는 것이다. 게임이론에서 말하는 '비용 없는 신호(costless signal)'와 크게 다르지 않다.

 

그러나 게임이론은 Cheap Talk가 언제나 신뢰받는다고 말하지 않는다. 오히려 보내는 사람과 받는 사람의 이해관계가 다를수록 Cheap Talk의 정보 가치는 급격히 떨어진다고 설명한다. 실명이 빠진 폭로는 진실을 밝히기보다 추측만 양산하기 쉽다. 사람마다 다른 이름을 떠올리고, 무관한 사람까지 의심받는다. 이것이 바로 Cheap Talk의 한계다.

 

정말 대한민국 형사사법제도를 흔든 '악마적 거래'를 알고 있다면, 이제는 Cheap Talk를 끝낼 때다. 실명을 밝히고, 언제 어디서 어떤 합의가 있었는지, 어떤 증거를 갖고 있는지 국민 앞에 공개하면 된다. 그것이 사실이라면 국민은 충분히 판단할 수 있다.

 

경제학은 또 하나의 중요한 교훈을 준다. 시장에서 신뢰를 얻는 것은 말이 아니라 '비용을 감수한 신호(costly signal)'. 정치도 마찬가지다. 실명을 공개하는 순간 발언에는 법적·정치적 책임이 뒤따른다. 바로 그 책임이 신뢰를 만든다. 이름을 숨긴 독설은 누구나 할 수 있지만, 책임을 걸고 사실을 공개하는 것은 아무나 할 수 없다.

 

김웅 전 의원은 검사 출신이고 국회의원까지 지낸 공인이다. 누구보다 증거와 책임의 의미를 잘 아는 사람이다. 그렇다면 "그 인간"이라는 연기 뒤에 숨지 말라. 정말 진실을 말하고 싶다면 이름을 말하라. 증거를 내놓으라. 그것이 공인의 책임이다.

 

실명을 감춘 채 독설만 던지는 것은 폭로가 아니다. 게임이론의 표현을 빌리자면, 그것은 추리 게임으로 끌어들이는 'Cheap Talk' 일 뿐이다. 정치적 목적으로 'Cheap Talk'을 활용한다면 이는 매우 비겁하다.
