보완수사권이란? 검찰 vs 경찰수사 차이가 뭘까?

여고생을 피살한 장윤기 살인사건을 보면 경찰수사는 검찰의 보완수사에 비해 지나치게 허술해 보였다. 같은 사건을 놓고  경찰과 검찰의 수사력은 왜 이렇게 큰 차이가 날까? 경찰은 장윤기가 밤12시를 넘긴 시각  혼자 귀가하는 여고생을 우발적으로 살인했다는 결론을 지었다.  장윤기가 무슨 일로 자책하여 자살하려다 여고생을 보고 범행심리가 옮겨 붙어 죽였다는 단순 살인이라는 것이었다, 그런데 검찰이 보완수사 해서 핸드폰 1년 치 사용 내용을 포렌식하고  장윤기가 대기시켜 놓은 차량의 CCTV 사진을 정밀검증해보니 뒷문을 열어놨고 차에 손발을 결박지을 케이블 노끈도 있고, 장윤기가 홀로 사는 집에 가서 보니 성노리개 인형이 있었다는 사실도 발견해 강간미수 살해사건 임을 밝혀냈다.

검찰심문에서도 성폭력의도가 있었냐는 추궁에  그렇다고 답변했다. 경찰은 이런 곡절에 대해 하나도 수사도 않고 많은 증거를 몰래 숨기는 범죄행위를 저질렀다. 경찰수사 결론대로라면  단순살해, 특히 성범죄가 개입되지 않을 경우 형량은 5년을 넘지 않으리라 한다. 그런데 강간실인죄는  20년일지 무기징역일지 비교도 안될 정도로 무거운 형량이  재판정에서 곧 가려질 것이다. 특히 장윤기는 부친이 경찰간부임이 드러나 이번 장윤기 수사과정에서 고위급 경찰관들이 여러명 개입돼 경찰가족임을 숨기고 형량이 무거운 성범죄가 연루되지 않은 것처럼 조작한 사실이 밝혀졌다.

 

경찰조직이 곧 범죄행위를 저지른 것이다. 일반국민이 보면 범죄집단에게 범죄수사를 맡긴 꼴이다. 전국 경찰의 숫자는 15만 명에 달하고 검찰은 2500명 판사는 3500명 수준이다. 경찰가족의 숫자가 압도적으로 많은 현실을 감안하면  검찰의 보완수사가 없다면 경찰들은 식은 죽먹기로 범죄에 가담도 하고 엉터리 수사를 내놓을 것이다. 그래서  검찰의 보완수사는 필요하다. 검찰수사와 경찰수사가 이렇게 하늘과 땅차이처럼 벌어지는 이유는 뭘까? 만약 장윤기가 검찰총장 아들이고 검찰이 보완수사를 했더라면 그래도 숨겨진  죄를 낱낱이 파헤쳤을까 물어보니 한 고검장출신은 "그렇다"고 답했다.

 

필자(나)는 전직고위 검찰출신들에게 경찰과 검찰의 수사문화가 어떻게 다른지 그 이유를 들어봤다.  일단 검찰의 세계에 들어선 검사는 자신이 맡은 수사사건의 결과가 재판정에서 뒤집히거나 자신이 불기소한 사건이 나중에 중죄로 드러날 경우 자신의 검찰인생이  완전 실패로 증명된다고 본다는 거다. 똑바로 수사하여 나중에라도 하자가 발견되지 않는게 사명이자 명예이며 그래야 자신의 앞날이 열린다고 생각한다. 수사결과는 자신의  승진, 명예도 얻고 훗날 더 고위직에 가거나 로펌에 좋은 조건으로 픽업돼 일신의 영달이 달린 인인생의 전부라고 보고 작은 이권에 눈을 돌리지 않는다는 것이다. 이 검사장은 "경찰가운데도 수사실력이 뛰어난 경우를 본 적도 있다"고 말한다. 그러나 일반적으로 경찰은 오랜동은 대충수사하고 검찰에 사건을 송치하면 알아서 하겠지라는 심리가 더 강하다.

 

수사를 잘한다고 출세길이 보장되는 것도 아니다. 그래서 적당히도 많고 정치권력에도 약해서 눈치를 슬슬 살피는 경우도 많다고 한다.  이권에의 유혹에도 상대적으로 약하고  낮은 계급에 한지역에 오래 근무하다 보니 서로봐주는 끼리끼리 문화에도 익숙해있다. 그걸 의무로 생각하기도 한다.

 

이번 장윤기 사건이 경찰문화를 보여준 셈이다. 검찰의 보완수사권이 없다면  장윤기에 희생된 여고생의 인권은 유린당했을 것이다. 사회적 약자일수록 더욱 그렇다. 이번 이념형 여성단체들까지 나서서 검찰의 보완수사권이 남겨져야한다는 기자회견에 나선 이유다.  마침 재헌절(7월17일)에 나온 갤럽여론조사에서도 우리국민의 61%는 검찰의 보완수사권이 폐지돼선 안된다고 힘을 실어줬고 폐지찬성론은 23%에 그쳤다. 차기 민주당대표 후보가운데 강성파의 지지를 받는 정청래는  검찰보완수사권 폐지법안을  선거일(8월17일)이전에 국회통과시키겠다고 호언장담해왔다. 매일매일 독촉이다. 그러나 장윤기 사건을 계기로 민주당내에서도 신중론이 대두되고 여론향배도 좋지 않아 조기 강행처리는 쉽지 않을 것 같다. 이번 당대표 선거는 김민석, 정청래가 여론조사에서 1,2위를 달리지만 사실상 명청대전(이재명-정청래 전쟁의 준말)이다.

 

오는 2018년 공청권을 이재명 대통령(김민석), 정청래 누가 행사하느냐  차기 정치생명이 걸린 사활전이다. 강성 정청래 파는 김어준 유시민 등 친노 친문세력을 등에 업고 있다. 유시민은 "대통령이 정치세력을 교체하려 한다. 증축을 하라고 했지 누가 재개발하라고 했느냐. 이재명은 필패할 것"이라는 독한 말을 퍼부었다. 친 정청래 강성세력이 검찰보완수사권 완전폐지에 목숨을 거는 투쟁을 하는데 무슨 악연이 작용하는지 전문가들에 물어봤다. 노무현에 대한 검찰 강압수사로 부엉이 바위에서 뛰어 내린 사건을 들었다. 검찰이 노무현을 죽였다는 것이다. 근래에는  문재인 정부 때 검찰이 (정부에 정면으로 대들어), 조국에 대한 수사, 이재명경기지사에  성남FC 지원 사건 등을 거론한다. 검찰은 자신들 맘대로 수사를 설계해 정국을 뒤흔드는 파워를 과시하는 악마성이 있다는 것이다. 차제에 뿌리 뽑아야 한다는 게 "민주당의 개혁과제 이며  이를 달성하지 못하면 국민이 민주당을 버릴 것"이라고 주먹을 흔들어댄다.  그런데 갤럽여론조사 결과는 정청래의 생각과 정반대다. 정청래 강경파가 보완수사권 완전박멸에 목을 거는 진짜 속셈은 뭔지 이 문제에 천착한 교수에게 들어봤다. "그 이유는 3가지다. 첫째, 검찰을 막바지 까지 공격했는데 살아나면(강성파들이) 수사로 보복 당할까봐 두려워지기 시작했다. 둘째,  지금이 아니면 다시는 때가 오지 않는다. 셋째, 무조건 검찰이 싫다..."

검사보완수사권 관철이 어려울 것 같으니까 보완수사요구권이란 해괴한 대안을 들고 나오는데 국민을 바보로 아는 짓이다. 보완수사권은 휴지나 다름없다' "절대권력은 절대 부패한다" (존 액튼) 경찰에게 전권을 주면 부패공화국이 될 것이다. 검찰은 경찰만 수사세력으로 존재한 퍠해를 극복하기 위해 1789년 프랑스대혁명이후 처음 설치됐으며 선진국가운데는  영국에서 1985년 가장 늦게 도입됐다. 지금 선진국가운데 검찰수사를 완전 배제한 국가는 거의 없다.

 

문재인 정권 때 검수완박을 들고 나왔다 실패하고 지금 강성파들이 파이널 투쟁을 벌이는데 국민여론은 반대다. 심지어 민주당지지자들조차 보완수사권 보존 46%, 폐지 39%로  존치여론이 더 높다. 인권보호라는 시대적 소명을 역행하는 배가 나타나면 강물(주인)은  그것을 엎어버릴 것이다.

They discovered that the rear door was open, there were cables in the car to bind the hands and feet, and upon visiting Jang Yoon-gi's home where he lived alone, they found a sex toy doll, revealing that it was a case of attempted rape followed by murder.

During the prosecution's interrogation, when pressed on whether there was an intent to commit sexual violence, he answered affirmatively. They argue that the prosecution possesses a devilish nature, flaunting its power to shake up the political landscape by designing investigations as they please. They wave their fists, declaring that rooting this out now is "the Democratic Party's reform agenda, and if this is not achieved, the people will abandon the Democratic Party." However, the results of the Gallup poll are the exact opposite of Chung Cheong-rae's views. We asked a professor who has delved into this issue about the true ulterior motive behind Chung Cheong-rae's hardliners staking everything on the complete eradication of supplementary investigation powers. "There are three reasons. First, they attacked the prosecution to the very end, but they began to fear that if they survived, they would face retaliation through investigations.
