브레이크뉴스 정명훈 기자= 윤석열 전 대통령이 12·3 비상계엄 선포 과정에서 국무위원들의 심의권을 침해하고 고위공직자범죄수사처(공수처)의 체포영장 집행을 방해한 혐의로 징역 7년의 실형을 확정받았다. 12·3 비상계엄 사태 이후 583일 만에 나온 첫 대법원 확정 판결이다.
대법원 3부(재판장 이흥구 대법관, 주심 이숙연 대법관)는 9일 특수공무집행방해와 직권남용 권리행사방해 등 혐의로 기소된 윤 전 대통령의 상고심에서 징역 7년을 선고한 원심을 확정했다.
윤 전 대통령은 지난해 1월 서울 용산구 한남동 대통령 관저에서 대통령경호처 직원들을 동원해 공수처와 경찰의 체포·수색영장 집행을 방해한 혐의로 재판에 넘겨졌다.
또 2024년 12월 3일 비상계엄 선포 직전 일부 국무위원만 소집해 국무회의 심의권을 침해한 혐의와 계엄 선포 다음 날 작성된 사후 계엄 선포문에 서명해 적법한 절차를 거친 것처럼 꾸민 혐의다.
이와 함께 해당 문서의 폐기를 승인한 혐의, 내란 수사 대상 군 장성들의 비화폰 서버 삭제를 지시한 혐의, 허위 내용이 담긴 대외 홍보자료 작성·배포를 지시한 혐의 등도 적용됐다.
1심은 징역 5년을 선고하며 체포영장 집행 방해에 대해 "경호처 공무원을 사병처럼 동원하고 공수처 검사 등과 물리적 충돌을 초래할 위험을 야기했다"며 죄질이 무겁다고 판단했다. 다만 일부 국무위원 심의권 침해와 허위 공보 지시 혐의는 무죄로 봤다.
2심 재판부는 사실상 참석이 불가능한 시점에 국무위원들에게 소집을 통보한 것은 심의권 침해에 해당한다고 판단했고, 허위 공보 지시 혐의를 유죄로 인정하면서 형량을 징역 7년으로 높였다.
대법원은 이날 원심 판단에 법리 오해가 없다고 보고 이를 그대로 확정했다.
이번 판결은 12·3 비상계엄 선포와 관련해 당시 최고 책임자인 윤 전 대통령에게 형사책임을 확정한 첫 사례다. 이날 선고는 대법원 소부 사건으로는 처음으로 생중계됐으며, 윤 전 대통령은 법정에 출석하지 않았고 법률대리인만 참석했다.
한편 윤 전 대통령은 별도로 진행 중인 내란 우두머리 혐의 1심에서 무기징역을, 평양 무인기 침투 관련 일반이적 혐의 1심에서는 징역 30년을 각각 선고받은 상태다.
한덕수 전 국무총리 재판에서 위증했다는 혐의로 1심에서 무죄를 받았고, 다른 4건의 형사 재판에서는 이달 1심 선고를 앞뒀거나 심리를 받고 있다.

The first-instance court sentenced the defendant to five years in prison, deeming the offense serious regarding obstruction of the execution of an arrest warrant, stating that the defendant "mobilized Presidential Security Service officials like private soldiers and created a risk of physical clashes with prosecutors from the Corruption Investigation Office for High-ranking Officials (CIO)." However, the court acquitted the defendant of the charges regarding the infringement of the Cabinet members' right to deliberate and the ordering of false public announcements.
The appellate court ruled that notifying Cabinet members of a meeting at a time when attendance was virtually impossible constituted an infringement of their right to deliberate, and while finding the charge of ordering false public announcements guilty, increased the sentence to seven years in prison. The Supreme Court determined on this day that there was no misunderstanding of the law in the lower court's judgment and confirmed it as is.
