"담합, 담합, 담합.." 공정위 올해 과징금 2조원 초과 전망

브레이크뉴스 최애리 기자= 공정거래위원회가 올해 설탕과 밀가루, 전분 및 전분당 등 식료품 원재료 담합 사건에 부과한 과징금이 1조8000억원을 넘어서며 연간 과징금 규모가 역대 최대를 기록했다. 

 

여기에 더해 현재 심의 중인 전분당 입찰담합 및 부산물 가격담합 사건까지 제재가 확정될 경우 관련 과징금 액수는 2조원을 넘어설 전망이다.

 

공정위는 지난 7일 대상, 사조씨피케이, 삼양사, CJ제일제당 등 전분당 제조·판매업체 4곳의 가격담합에 대해 총 7476억원의 과징금을 부과하기로 최종 결정했다고 밝혔다.

 

이에 따라 올해 식료품 원재료 담합 사건으로 확정된 과징금은 총 1조8155억원으로 집계됐다. 

 

이는 종전 최대 기록인 2017년 1조3330억원을 넘어선 규모이다. 지난해 식료품 담합 사건 전체 과징금 3401억7300만원인 것과 비교한다면 5배를 웃돈다.

 

올해 공정위 과징금이 급증한 것은 국민 생활과 밀접한 설탕, 밀가루, 전분 및 전분당 시장에서 대형 담합 사건이 잇따라 적발됐기 때문이다. 

 

공정위는 지난 2월 설탕 가격을 6년간 담합한 제당업체 3곳에 3960억원의 과징금을 부과했으며, 5월에는 밀가루 공급가격과 물량을 담합한 제분업체 7곳에 당시 역대 최대 규모인 6710억원의 과징금을 부과했다. 

 

이번 전분·전분당 가격담합 사건에는 이를 넘어서는 7476억원의 과징금이 내려졌다.

 

현재는 전분당 입찰담합과 부산물 가격담합 사건도 심의가 진행 중이다. 두 사건의 관련 매출액은 총 2조4900억원으로, 과징금 상한인 20%를 단순 적용할 경우 최대 4980억원의 과징금 부과도 가능하다. 이에 따라 올해 식료품 원재료 담합 과징금은 2조3000억원대까지 늘어날 가능성이 제기된다. 

 

이에 따른 기업별 부담도 상당할 것으로 예상된다. 

 

설탕·밀가루·전분당 담합 사건 과징금을 합산하면 삼양사가 4353억원으로 가장 많고, CJ제일제당 3730억원, 대상 2341억원 순이다. 

 

삼양사의 과징금은 지난해 영업이익의 약 3.9배, 대상은 지난해 영업이익을 웃도는 규모다. 중소 제분업체인 한탑과 삼화제분 역시 과징금이 지난해 영업이익의 각각 약 8.4배와 7.8배에 달하는 것으로 나타났다.

 

공정위는 수천억원대의 과징금이 부과된 데 대해, 이들 업체들이 장기간에 걸쳐 담합행위를 해왔기 때문이라고 했다.

 

남동일 공정위 부위원장은 "이번 사건은 7년 5개월에 걸친 장기간 담합으로 관련 매출액이 누적된 사안"이라며 "전년도 영업이익이 아니라 장기간 담합을 통해 얻은 이익을 고려해 과징금을 산정했다"고 설명했다.

 

이어 "최근 5년간 평균 영업이익률이 약 3.8% 수준인 점을 감안하면 부당이득을 환수하기에 충분한 수준의 과징금이 부과됐다고 본다"고 밝혔다.

When the fines for the sugar, flour, and starch-sugar price-fixing cases are combined, Samyang Corporation has the highest amount at 435.3 billion won, followed by CJ CheilJedang at 373 billion won and Daesang at 234.1 billion won.

 

Samyang Corporation's fine is approximately 3.9 times its operating profit from last year, while Daesang's fine exceeds its operating profit. Small and medium-sized flour millers Hantop and Samhwa Flour Mills also faced fines amounting to approximately 8.4 times and 7.8 times their operating profits from last year, respectively. He further stated, "Considering that the average operating profit margin over the past five years has been approximately 3.8%, we believe that the imposed fines are sufficient to recover the unjust gains."
