필자는 지난 5월13일 이명산 중앙정보국(CIA) 전 요원(은퇴)과 저녁을 함께 했다. 저녁을 함께 하면서 이러저런 대화를 했다.
북한에 끌려갔던, 영화감독 신상옥-최은희 부부가 미국으로 망명(1986년 3월) 했다. 그 부부는 그 직후 워싱턴 워터게이트 호텔의 지하에서 망명후 첫 기자회견을 했었다.
필자는 이때, 기자로서 이 회견장에 참석했었다. 이명산 중앙정보국(CIA) 전 요원은 신상옥 감독의 망명공작을 담당했던 요원이었다. 필자는 이 분을 이때부터 알고 지냈으니, 오랜 동안 교유해온 셈이다.
최근, 중앙정보국(CIA)에 근무하던 시절에 취득한 정보를 활용해서 “대한민국 현대사의 숨겨진 진실(대양미디어 출간)”이라는 저서를 출간했다.
이 책의 맨 앞부분에는 중앙정보국(CIA)의 출판허가서가 배치-게재됐다. 중앙정보국(CIA) 전직 요원이라, 책 내용에 대한 감수가 필요했다고 한다.

미국의 해외 전담 정보기관인 중앙정보국(CIA)은 취득한 정보를 년 단위로 해제하는 제도가 있다. 미국 중앙정보국(CIA)을 비롯한 미국의 정보기관들은 국가 행정명령에 따라 생산된 지 25년이 지난 기밀문서를 매년 자동으로 일반에 공개하는 ‘25년 자동 비밀해제(Automatic Declassification)’ 제도를 운영하고 있는 것.

▲제도의 법적 근거=이 제도는 1995년 빌 클린턴 대통령이 서명한 행정명령 제12958호(Executive Order 12958)로 처음 도입됐다. 이후 버락 오바마 대통령이 개정한 행정명령 제13526호를 통해 현재까지 엄격하게 이어져 오고 있다. 정부의 책임성과 투명성을 높이고, 국민의 알 권리를 보장하기 위해 마련된 민주적 장치이다.
▲'매년 연 단위'로 롤링되는 자동 해제 방식=기밀 해제는 고정된 시점에 멈춰 있는 것이 아니라, 매년 한 해씩 앞으로 이동하는 '롤링(Rolling)' 방식으로 진행된다. 역사적 가치가 있는 영구 보존 문서들은 별도의 공개 청구가 없더라도 매년 12월 31일을 기점으로 딱 25년 전 생산된 문서들이 자동으로 비밀 해제 대상이 된다. 예를 들어, 현재 시점(2026년) 기준으로는 2001년 이전에 작성된 CIA 기밀문서들이 순차적으로 자동 해제 검토를 거쳐 대중에게 전면 개방된다.
▲예외적인 기밀 유지 조항 (9가지 면책 사유)=25년이 지났다고 해서 모든 정보가 100% 무조건 공개되는 것은 아니다. 국가 안보에 치명적인 영향을 줄 수 있는 9가지 예외 범주(Exemptions)에 속하는 정보는 심사를 거쳐 기밀 유지를 연장할 수 있다. -인간 정보 자산(HUMAN Source): 기밀 요원, 협력자, 정보 출처의 신원이 탄로 날 위험이 있는 경우. -대량살상무기(WMD) 및 암호체계: 미국의 핵무기 정보나 첨단 군사·암호 기술이 포함된 경우, -진행 중인 외교 관계: 해당 정보가 공개되었을 때 우방국과의 외교적 관계나 진행 중인 비밀 공작을 현저히 저해하는 경우. 이러한 예외에 해당하더라도 문서 전체를 숨기는 것이 아니라, 문제가 되는 핵심 단어나 문장만 검은색으로 지우는 '블랙아웃(Redaction)' 처리를 한 뒤 나머지 내용은 최대한 공개한다. 또한, 50년 혹은 75년이 지나면 이러한 예외 조항조차 유지하기가 극도로 까다로워진다.
▲공개된 문서를 보는 방법=CIA는 이 제도로 해제된 수천만 페이지의 방대한 역사적 문서를 CREST(CIA Records Search Tool)라는 전자문서 검색 시스템에 등록해 둔다. 일반인 누구나 CIA 독서실(CIA Reading Room) 공식 웹사이트에 접속하면 냉전 시기 작전, 한국전쟁 관련 첩보 보고서, 역사적 사건의 이면 등을 무료로 검색하고 열람할 수 있다.

우리나라(한국)는 국가정보원(중앙정보부-안기부 후신)에 관한 비밀해제 법령이 없다. 우리나라의 최대 국가 정보기관인 국가정보원(NIS)도 미국의 중앙정보국(CIA)처럼 일정기간이 지나면 비밀을 해제하는 법령이 만들어졌으면 한다. 국가의 세금으로 얻어진 고급정보이니 국민에게로 돌아가는 게 순리라고 생각한다. moonilsuk@naver.com

On May 13th, I had dinner with Lee Myung-san, a retired former CIA agent. We talked about various things over dinner.
Film director Shin Sang-ok and his wife Choi Eun-hee, who had been taken to North Korea, defected to the United States in March 1986. Immediately afterward, the couple held a press conference regarding their defection in the basement of the Watergate Hotel in Washington. I attended this conference as a reporter. - Ongoing Diplomatic Relations: Cases where the disclosure of such information would significantly impede diplomatic relations with allies or ongoing covert operations. Even if these exceptions apply, the entire document is not hidden; instead, a "Redaction" process is used to black out key words or sentences that are problematic, while the remaining content is disclosed as much as possible. Furthermore, after 50 or 75 years, maintaining even these exception clauses becomes extremely difficult.
▲ How to View Released Documents = The CIA registers tens of millions of pages of vast historical documents declassified through this system into an electronic document search system called CREST (CIA Records Search Tool). Anyone can access the official CIA Reading Room website to search and view Cold War operations, intelligence reports related to the Korean War, and the hidden aspects of historical events for free.
I am the author of *The Central Intelligence Agency* (3 volumes). Therefore, I have a keen interest in domestic and international intelligence agencies. Our country (Korea) has no declassification laws regarding the National Intelligence Service (NIS), the successor to the Central Intelligence Agency and the Agency for National Security Planning.
