브레이크뉴스 박동제 기자= 검찰이 사회복무요원 ‘부실 복무’ 의혹을 받는 그룹 위너 멤버 송민호에게 징역 1년 6개월을 구형했다.
21일 서울서부지법 형사10단독(판사 성준규)에서 병역법 위반 혐의를 받는 송민호와 복무 관리 책임자 A씨에 대한 첫 공판이 진행됐다.
이날 검찰은 “피고인이 장기간 무단결근하며 실질적으로 근무하지 않았고, 이를 감독기관에 허위로 소명한 것으로 보인다“며 송민호에게 징역 1년 6개월을 선고해달라고 재판부에 요청했다.
송민호 측 변호인은 “공소사실을 모두 인정한다”며 “대한민국 청년으로서 성실히 수행해야 할 국방 의무를 다하지 못한 걸 뼈저리게 반성한다"고 밝혔다.
이어 송민호 측은 “범행 당시 피고인은 양극성 정동장애와 극심한 공황, 경추 파열 등 육체적, 정신적 고통을 겪어 정상적인 복무가 어려운 상태였다”면서 “성실한 사회 일원으로 복귀할 수 있도록 선처해달라”고 호소했다.
이날 검은색 정장 차림에 뿔테 안경을 쓰고 출석한 송민호는 최후진술에서 “대한민국 청년으로서 반드시 이행해야 할 국방의 의무를 끝까지 성실히 이행하지 못했다”며 “많은 사람들의 사랑을 받는 사람으로서 모범을 보이지 못한 점 부끄럽고 죄송스러운 마음”이라고 말했다.
그러면서 송민호는 “조울증과 공황장애를 앓고 있지만 결코 변명이나 핑계가 될 수 없다는 것을 잘 알고 있다”며 “현재 치료를 받고 있다. 하루 빨리 건강을 회복해 재복무 기회가 주어진다면 끝까지 성실하게 마치고 싶다”고 덧붙였다.
반면 송민호 근무지 이탈에 공모한 혐의로 함께 기소된 복무 관리 책임자 A씨는 이날 재판에서 공소사실을 부인했다.
A씨에 대한 다음 공판은 내달 21일 열릴 예정이며, 송민호의 1심 선고 날짜는 재판부가 추후 지정하기로 했다.
한편, 송민호는 지난 2023년 3월 24일 육군 훈련소에 입소해 기초 군사 훈련을 받은 뒤 사회복무요원으로 대체복무를 이어왔고, 2024년 12월 23일 서울 마포주민편익시설에서 대체복무를 마치며 소집해제 됐다.
그러나 송민호는 서울 마포구 시설관리공단 및 주민편익시설에서 사회복무요원으로 근무하던 중 총 102일을 무단으로 결근, 정당한 사유 없이 복무를 이탈한 혐의를 받고 있다.
병역법 제89조의2는 ’정당한 사유 없이 통산 8일 이상의 기간 복무를 이탈한 자는 3년 이하의 징역에 처한다’고 규정돼 있다.
