국회 고용·노동 계류법안..규제 강화 229개 VS 완화 30개

한경연, 강화법 완화법의 7.6배..기업 경영 부담 가중

국회에 계류된 고용·노동법안 중 규제강화 법안이 규제완화 법안의 7.6배에 달하는 것으로 밝혀졌다.

 

한국경제연구원이 21대 국회 개원이후 올해 2월 10일까지 국회 환경노동위원회에 계류된 법안을 분석한 결과다.

 

환노위 계류 법안 총 530개 중 고용·노동 법안은 364개로 68.7%를 차지했다. 고용·노동 법안은 △규제강화 229개(62.9%) △중립 93개(25.6%) △규제완화 30개(8.2%) △정부지원 12개(3.3%) 순이었다. 규제를 강화하는 법안의 개수가 규제완화 법안의 개수보다 7.6배에 달하는 것이다.

 

규제강화 법안을 유형별로 분석해보면 △비용부담 증가 88개(38.4%) △추가의무 부과 71개(31.0%) △책임범위 확대 20개(8.8%) △처벌 강화 17개(7.4%) △사회적 압력 증대 17개(7.4%) 순으로 발의됐다.

 

비용부담을 추가하는 주요 법안에는 △계속근로기간이 1개월 이상인 근로자에 대해 퇴직급여제도를 의무화 △하청근로자 산재발생 시 원청 보험료율 반영 △업무가 아닌 일로 인한 부상 또는 질병에 대해서도 휴가청구권 보장 △노조의 불법적 활동으로 인한 손해에 대한 배상청구 금지 등이 있다.

 

퇴직급여는 장기근속에 대한 공로보상을 포함하는 것임에도 1개월 근무한 일용직에게까지 퇴직금을 지급할 경우, 추가 인건비 부담으로 인한 고용감소와 기업의 안정적 인력 운용을 저해할 것으로 우려된다.

 

하청근로자의 산재가 발생할 경우 원청의 보험료율에 반영하는 것은 하청의 보험료 부담을 원청이 책임져야 함으로써 관련 비용부담이 증가한다.
