Allegations Surrounding Nominee Kim Seung-won and a Hearing Without Witnesses: Does the Democratic Party Have the Standing to Speak of the Rule of Law?

The moral integrity and professional suitability of Kim Seung-won—the nominee for Minister of Justice, a role that demands he serve as a guardian of the nation's legal order—are now hanging by a thread. A series of emerging allegations—stemming from recently released transcripts, the progression of investigations, internal reports from the Ministry of Food and Drug Safety (MFDS), and his relationships with figures linked to the "Genencell" case—suggest the possibility of organized lobbying driven by vested interests.

Nominee Kim’s camp maintains that the matter regarding the approval of Genencell’s clinical trials was merely a routine public petition made in the public interest. However, evidence points to something far more significant: directives issued by the MFDS Commissioner to working-level staff, the subsequent drafting of separate reports, and indications that the issue was reported directly to the Commissioner—bypassing standard procedures. These circumstances strongly suggest that the petition was not merely an expression of opinion but an act that exerted considerable influence over the official administrative system.

Statements made in the released transcripts, in which a broker named Yang appears to boast of his connections and influence, further raise questions about how he may have intervened in the MFDS approval process. These details inevitably fuel curiosity regarding how the vested interests surrounding Genencell were established and expanded, as the emerging facts are difficult to reconcile with the explanation that this was simply the relaying of a public petition.

Compounding these issues are allegations that the death of hamsters during efficacy trials was concealed, raising serious concerns about the safety of the new drug and the credibility of the experimental data. Given that this matter directly impacts public health, the truth must be established through objective verification rather than political wrangling. It is particularly telling of the Democratic Party’s moral paralysis that one of its officials retorted, “Does a hamster dying automatically mean it was poisoned?” in response to an issue where even medical specialists have raised serious doubts about the credibility of the experimental data.

Furthermore, revelations that the child of Presiding Judge Jeong—who had dismissed the warrant in the Genencell case—worked in Candidate Kim’s parliamentary office have sparked questions about whether the connection between the two parties is merely coincidental. Given the controversy surrounding the propriety of these judicial ties involving the Justice Minister nominee, a public explanation that satisfies the people is essential.

What is even more disheartening is the Democratic Party’s complacent and arrogant attitude toward this situation. It is pitiful to see them dismiss efforts to uncover the truth behind the allegations as mere political attacks and even push for a bill to suspend the qualifications of an opposing lawmaker. Their use of an overwhelming parliamentary majority to block the very scrutiny of these allegations is truly deplorable.

If the Democratic Party is confident that the allegations against the nominee are baseless, there is no reason to refuse the appearance of witnesses. They could simply summon the broker (Mr. Yang), Genencell officials, and relevant personnel from the Ministry of Food and Drug Safety to verify the facts. Yet, by excluding all key figures and opting to hear only the nominee’s own explanation, the process appears less like public scrutiny and more like a one-sided attempt at self-justification.

Seo Young-kyo, Chair of the Legislation and Judiciary Committee, argues that “the nominee is, in effect, the witness.” However, a nominee’s own explanation and the cross-verification of the parties involved in the allegations are entirely different matters. Her stance is a textbook example of hypocrisy—completely contradicting her past insistence on the necessity of calling witnesses. An attitude that seeks to hear only the candidate's explanations while excluding key witnesses will inevitably fuel public suspicion.

It is even pitiful to see the Democratic Party leadership shielding the candidate, claiming he is "explaining things well" and that "there are no issues." Their hostile behavior toward whistleblowers also raises questions once again about the abuse of power. The rule of law is being stifled by a double standard: why is the call for "stern punishment for stock price manipulation"—championed by Lee Jae-myung during his time as party leader—suddenly met with leniency when the allegations involve his own inner circle?

The moment those in power prioritize partisan interests over uncovering the truth, the rule of law is reduced to a mere ornament for power. The Democratic Party must—even now—withdraw its refusal to call witnesses and submit the allegations to public scrutiny. The "shielding" tactics used to conceal suspicions and block verification will ultimately turn against them. They must not forget that while power is fleeting, the public's judgment and the record of history endure.
