Allegations surrounding Justice Minister nominee Kim Seung-won are escalating... “Saving ‘Oppa’ Kim Seung-won?”
- Lee Yang-seung, Professor at Kunsan National University
It would be easier to say, “Saving Private Kim Seung-won.” However, South Korea—especially political parties tightly bound by vested interest cartels—is neither altruistic nor idle enough to pour resources into saving a mere “private.”
In game theory, “moral hazard” refers to “hidden action.” The key is to design systems so that hidden action cannot exist in the first place. However, no system is perfect. Human-made systems are based to a certain degree on conscience. While there are many conscientious people, not everyone is. Therefore, surveillance is inevitable for systems. This is not to doubt people’s good intentions, but to protect those good intentions from the malice of bad people.
The so-called "new drug lobbying" allegations surrounding Justice Minister nominee Kim Seung-won are becoming increasingly absurd. If the allegations are true, biotech companies, lobbyists, politicians, and regulatory agencies are linked like a single chain. The core of the suspicion is that lobbyists made requests to politicians, politicians contacted the head of the Food and Drug Safety Administration, and subsequently, there was undue influence on the approval process. If this is true, this is not a matter of conduct, but a matter concerning the nation's drug safety system.
The response from some within the ruling party to this is truly preposterous. Instead of attacking the substance of the allegations, they attacked where Representative Han Dong-hoon obtained the data. Claims even emerged that he had leaked investigation records from the prosecution. However, according to reports, the relevant recordings originated from a public interest report submitted to the prosecution by an insider with knowledge of the internal situation. The report was made because the insider determined there were issues with the safety of the drug to be administered to humans and with the clinical trial process.
It is akin to scolding the finger pointing at the moon instead of looking at the moon itself. Even more preposterous is the attitude of the forces that have claimed to be progressive. They have long advocated for protecting whistleblowers. They called for breaking the collusion between power and corporations. They called for the dismantling of vested interest cartels. However, if suspicions are directed at politicians within their own camp, and they doubt the informant rather than the content of the tip-off, and attack the whistleblower, one cannot help but ask:
Is exposing the corruption of others considered whistleblowing in the public interest, while exposing corruption on our side is considered political maneuvering? Such "selective" justice is relative. It is not relative justice. Moreover, the person at the center of the allegations is a nominee for Minister of Justice. This is a position where he must apply the laws and principles applicable to others to himself more strictly than anyone else. If the ruling party is truly innocent, there is no need to attack Han Dong-hoon. They simply need to disclose the recordings, the circumstances of the phone calls, and the decision-making process of the Ministry of Food and Drug Safety, and demand an independent investigation. If there were no issues, the investigation will restore his honor.
There should be no distinction between ruling and opposition parties, conservatives and progressives, or left and right when it comes to corruption. If you dislike Han Dong-hoon, you should criticize him. However, attacking the messenger does not erase the message. It is utterly cowardly to brand a public interest whistleblower as a traitor and hide the subject of the allegations within the walls of one's own camp.
Those who once called for an investigation without sacred cows are now creating sacred cows in front of their own side. The very vested interest that the public despises the most is precisely such a shameless vested interest. yslee1992@hotmail.com
