[Here is the English version of the article] Gijang County Seeks State Audit Over Jukdo Purchase, Reports Original Owner Missing

Gijang County in Busan said it will ask South Korea’s Board of Audit and Inspection to review its purchase of Jukdo from Shinangchon and will file a missing-person report for Park, the second leader of Shinangchon and the island’s original owner, after raising questions about the sale process and related documents.

Gijang County Mayor Woo Seong-bin announced the plans at a news conference on the 7th. Woo is leading a county task force investigating what it describes as possible corruption and wasteful spending involving the Jukdo project.

The county’s main concern is that it did not directly confirm whether Park intended to sell the island before the purchase contract was signed.

A letter of intent to sell submitted on March 2, 2023, was filed in the name of the CEO of Shinangchon Food Co., Ltd., rather than Park, whom the county identifies as the original owner of Jukdo. The county also said it had no direct face-to-face meeting, phone call or video call with Park to confirm his intention to sell before entering into the contract.

The county said these circumstances raise questions about whether Park was in a position to communicate his intentions at the time and whether his whereabouts and status should have been confirmed. It therefore plans to file a missing-person report.

The county also raised questions about the authority of those who claimed to represent Park and signed the purchase agreement.

The county identified several issues requiring further review.

First, it questioned whether the process for initiating the sale was appropriate because the letter of intent was submitted by the CEO of Shinangchon Food rather than the alleged owner himself.

Second, the county pointed to a possible defect in the contract documents, saying that a copy of the seller’s identification was not included with the power of attorney.

Third, it raised concerns about the seal certificate submitted for the transaction. The county said the seller’s seal certificate was issued through a proxy and that the power of attorney was reportedly not handwritten by the seller. It also said a general seal certificate, rather than one issued specifically for a real estate transaction, was submitted.

Fourth, the county questioned whether the contract was properly executed because the designation of the seller’s representative and the representative’s signature or seal were reportedly missing from the contract.

Fifth, the county said three law firms that advised it — Shinsung, Kukje and Seongan — had recommended confirming the seller’s identity and intent through a phone call, in-person meeting or video call before signing the contract. The county said those recommendations were not implemented.

Sixth, the county said the shared-property management plan and related approval process by the local council did not reflect the fact that the seller’s identity had not been directly confirmed or that the three law firms had recommended additional verification.

Finally, the county raised questions about a handwritten signature on a Jukdo appraisal consent and recommendation form, saying it is presumed not to match the signature of the actual seller.

The county said these issues raise the possibility that some of the procedures and legal requirements surrounding the transaction may not have been properly followed, but emphasized that the facts require further investigation.

“We need special measures to protect the taxpayers’ money that has already been spent, as well as future national funding,” Mayor Woo said. “We will thoroughly establish the facts and make sure that no additional taxpayer money is wasted.”
