Allegations of New Drug Lobbying, Kim Seung-won's 'Broke of Trust' and 'Circumference of the Dinner Table'...

- Lee Yang-seung, Professor at Kunsan National University

A photo related to Justice Minister nominee Kim Seung-won is circulating on social media. The first thought that comes to mind is how much 'rice' he has eaten. 'Rice' and 'law'... In Korea, 'rice' is more important than 'law'. In the movie *The Golden Age of Bad Guys*, even after being taken to the police station, the villain Choi Hyung-bae (played by Choi Min-sik) threatens the officers, saying, "...Yesterday, I had a meal with your chief, you punk... blah blah blah..."

It is not only law and money that move society. "Trust" is also an important form of capital. There is a concept called the "radius of trust" mentioned by Francis Fukuyama. It is a matter of how far one can trust and cooperate with others, extending beyond family, friends, alumni, and acquaintances.

In a society with a wide radius of trust, even strangers trust the system and engage in transactions. Conversely, when that radius narrows, "personal connections" become more important than "regulations."

A prime example is the criticism that Korean soccer is "network soccer."

In Korea, one of the most powerful mediums connecting this narrow radius of trust is "food." When we meet people, we eat first. The phrase "Let's grab a meal sometime" is not merely a simple dinner promise. It relates to relationships. It means to create connections; once a relationship is established, phone calls become possible, and once phone calls become possible, requests become possible. A single meal becomes a network, and a network, in turn, becomes influence.

The reason the allegations surrounding Justice Minister nominee Kim Seung-won regarding the "Genencell new drug lobbying" are uncomfortable is that they bring to mind this kind of Korean-style network. If we simplify the links in the reported incident, it goes like this:

"Pharmaceutical company official, businessperson, National Assembly member, Minister of Food and Drug Safety, working-level official"...

Nominee Kim explains that he merely requested that the clinical trial procedures of a domestic small and medium-sized enterprise (SME) be reviewed to ensure they were not unfairly delayed during the COVID-19 pandemic. He asserts that he did not demand approval or ask for standards to be lowered. Of course, that explanation should be respected.

However, the essence of the problem lies elsewhere. It is why a corporate petition must be conveyed to the Minister of Food and Drug Safety through a National Assembly member.

Furthermore, it is reported that the pharmaceutical company official in question was later found guilty in a separate first-instance criminal trial, having been found guilty of charges including submitting false data to obtain patent and clinical trial approvals. There is no evidence that Nominee Kim was aware of this. Rather, it is precisely because of this that politicians Intervening in professional regulatory procedures is dangerous. This is because lawmakers are not experts capable of assessing drug efficacy and toxicity.

The same applies to the market economy. Clinical trial approvals serve as a signal to investors. Investors trust the "system" known as the Ministry of Food and Drug Safety. However, when a politician's phone call appears during the approval process, the market evaluates not only the company's technological capabilities but also its "connections."

At that moment, companies have an incentive to invest in networks rather than research and development. That is the problem.

The issue with Korean society is not a lack of trust, but rather that the radius of trust is too narrow. People seek out alumni, acquaintances, people to share meals with, exchange contact information, and look for someone to make requests to. While trust among close acquaintances is strong, those outside the system become increasingly alienated. As the density of private trust increases, the radius of public trust actually narrows.

Therefore, what is required of the Minister of Justice is special. The Ministry of Justice must instill in the public the belief that justice is realized even without personal connections. The same laws and procedures must be applied fairly, regardless of whether prosecutors, judges, or the Minister are aware of them.

The Minister of Justice's A margin of trust should not be measured by the "circle of the dining table." There is no crime in meeting people and sharing a meal. However, the story changes the moment relationships are built over food, relationships turn into solicitations, and solicitations influence public procedures.

The Minister of Justice must be someone who expands the radius of the law. They must not expand the "radius of food." That would make them a "Minister of Food." A nation governed by the rule of law is one where fairness applies even without personal connections. Currently, Korea is a "nation governed by food," ruled not by the law. yslee1992@hotmail.com
