Justice Minister Nominee Kim Seung-won, Answer the Allegations Before Talking About the Rule of Law!
- Columnist Jung Sung-tae
Recently, allegations surrounding Justice Minister Nominee Kim Seung-won regarding the solicitation of approval for a COVID-19 treatment clinical trial plan have emerged as a matter of national interest, not just in political circles, and are spiraling into a volatile situation. While the nominee's side argues that this is merely a "public grievance," concrete circumstances—such as transcripts and prosecution reports—emerging from the media and political circles are fueling public concern.
Above all, the position of Justice Minister, which wields immense influence over the criminal justice system and the operations of the prosecution, demands a high level of morality, public service ethics, and trust in the rule of law. However, the depth and nature of the raised allegations are too fatal to be dismissed as mere political attacks. One cannot help but sternly question whether Nominee Kim is truly qualified to bear such weight.
And that is not all. The leaked transcripts include a remark stating, "The moment it gets approved by the Ministry of Food and Drug Safety, you can make hundreds of billions of won," and reveal evidence of close communication with figures associated with pharmaceutical companies. This raises questions as to whether Candidate Kim acted as an accomplice involved at the center of interests, going beyond merely conveying a petition. In particular, the conversation stating, "If things go well, you can just put in a donation," raises serious concerns regarding his status as a candidate for a high-ranking public office, regardless of whether actual bribery occurred.
The People Power Party is tightening its grip on Candidate Kim, arguing that his suitability for the ministerial role is "absurd." Party leader Jang Dong-hyuk asserted, "If he were a proper lawmaker, he should have met with stakeholders or staff to understand the situation, yet he merely conveyed a broker's petition." He further claimed that the conversation instructing him to "put in a donation if things go well" constitutes a clear "promise to offer a bribe." Jeong Jeom-sik, the floor leader of the People Power Party, also strongly demanded the withdrawal of the nomination, pointing out that “the very fact that someone granted a suspended indictment in a bribery case becomes the Minister of the department responsible for the Public Prosecution Service constitutes a massive conflict of interest.” The criticism is that the very fact that a nominee for Minister of Justice, who will wield immense influence over the criminal justice system, is the very party at the center of the controversy surrounding his own suspended indictment could undermine public trust in judicial justice.
According to current reports, on September 14, 2021, Ms. Yang introduced Mr. Kang, the CEO of Genencell, to nominee Kim, saying, “He’s good for you when you’re running for election…” and implying that he was “someone who would be a source of strength for you.” To this, nominee Kim reportedly replied, “Then shall we meet right after Chuseok?”
Subsequently, on October 6, 2021, Mr. Kang, the CEO of Genencell, asked Mr. Yang to “ensure that approval for the new drug clinical trial is obtained quickly through political connections.” Mr. Yang conveyed this request to Candidate Kim the following day, and Candidate Kim reportedly also requested expedited processing from the then-Minister of Food and Drug Safety. Ultimately, the clinical trial plan was approved on October 26, just two weeks after Candidate Kim requested expedited processing.
Furthermore, in the 2024 case involving Mr. Kang, the CEO of Genencell, the court acknowledged the charge of attempting to inflate the company’s stock price by creating false data through methods such as manipulating animal experiment results and omitting side effects. However, the court’s judgment regarding the Genencell official does not automatically imply Candidate Kim’s responsibility. Nevertheless, the specific circumstances under which Candidate Kim became involved in this matter at the time need to be investigated even more rigorously.
In conjunction with this, the release of an investigation report revealing that the investigative team at the time had considered indicting Candidate Kim and seeking a prison sentence has brought the circumstances leading to the subsequent suspension of indictment into new controversy. Candidate Kim argues that the suspension of indictment was unjust and that he should have effectively been found not guilty. However, a suspension of indictment is different from a court's acquittal or the prosecution's decision of no charges.
Suspicions regarding this investigative process could ultimately lead not only to concerns about the rule of law but also to distrust in the Lee Jae-myung administration itself. If Candidate Kim remains stuck in a defense logic during the confirmation hearing that the investigation was merely politically motivated, he will be leaving a grave stain on the position of Minister of Justice, which should serve as a bulwark of criminal justice.
Even progressive civic groups like the People's Solidarity for Participatory Democracy and the Justice Party have come forward to question Candidate Kim's qualifications. The Justice Party demanded the withdrawal of his nomination, while the People's Solidarity urged for sufficient explanation and thorough verification. This suggests that the case in question is not merely a matter to be contested based on partisan logic, but rather a matter of qualifications as a high-ranking public official. Furthermore, with the added factor of a history of drunk driving in 2008, it is likely that the public's sense of justice will also be uneasy.
Candidate Kim has consistently advocated for prosecution reform. However, the legitimacy of such reform depends not on the political needs of the proponents, but on whether the public can trust its fairness. Moreover, given that a figure who has argued for the withdrawal of charges in cases involving President Lee Jae-myung has been nominated as the Minister of Justice, and that he himself is a party to the controversy surrounding the prosecution's decision to suspend indictment, he must sincerely address the public's concerns regarding potential conflicts of interest.
Precisely between the lines, one is compelled to ask whether Candidate Kim’s actions, which he described as a "public interest grievance," were perceived by some as a channel for massive private gain involving brokers. The public interest whistleblower statement released by People Power Party Representative Park Jung-hoon contains the claim that "an agreement was reached to pay 1 billion won in the name of investment funds if the solicitation was successful." While the facts of the matter must ultimately be verified, such specific testimony raises doubts as to whether the complaint at the time was truly nothing more than a grievance purely for the public interest.
The public is now asking: If the Minister of Justice, who wields immense influence over our society's criminal justice system, hides behind a political shield without even being able to fully explain his own allegations to the public, where is the rule of law in the Republic of Korea headed? This does not mean, however, that a crime has been confirmed. The question is whether allegations of this magnitude can truly be dismissed lightly, even when viewed from the perspective of the moral and ethical standards required of a nominee for Minister of Justice.
What the public demands first from those who speak of the rule of law is not grandiose slogans of reform. It is the attitude of transparently explaining the allegations surrounding oneself and confidently answering the public's questions. If Candidate Kim intends to speak of the rule of law as Minister of Justice, his starting point must be right there as well.
