현행법상 문화체육관광부 장관은 체육 단체의 비리 및 인권침해에 대해 징계를 요구할 수 있다. 하지만 태백시체육회 임원 갑질, 용인시체육회 막말, 제주시체육회 회장 성추행 논란 등 최근 불거진 사건들에서 볼 수 있듯이, 체육 단체가 자체 재심을 통해 솜방망이 징계를 내리거나 무혐의 처리하는 경우가 비일비재하게 발생하고 있다. 이는 피해자에게 2차 피해를 입히고, 체육계 전체의 신뢰를 무너뜨린다는 비판을 받아왔다.
실제로 스포츠윤리센터에 신고된 사건들에서도 이런 문제는 반복되고 있다. 특정 시체육회 회장의 인권침해 사건은 윤리센터의 징계 요구에도 불구하고 자체 공정위에서 ‘견책’에 그쳤고, 도 탁구협회 회장 당선자의 폭행 사건 역시 ‘품위유지의무 위반’으로 ‘견책’ 처분이 내려지는 등 미흡한 조치가 이어졌다. 심지어 축구협회 회장의 성추행 사건은 무징계로 넘어가려다 뒤늦게 ‘자격정지 5개월’ 처분이 내려지는 등 체육계의 부실한 자체 정화 능력이 여실히 드러났다.
이번 개정안은 이러한 문제점을 해결하기 위해 외부 기관에 징계 권한을 부여하는 것이 핵심이다. 개정안이 통과되면, 스포츠윤리센터나 수사기관이 조사·수사를 시작하면 해당 체육 단체는 내부 징계 절차를 진행할 수 없게 된다.
또한, 대한체육회·대한장애인체육회 임원에 대한 징계 권한은 문화체육관광부 장관에게, 그 밖의 체육 단체 임원에 대한 징계 권한은 대한체육회·대한장애인체육회에 부여된다.
진종오 의원은 “체육회 내부의 솜방망이 징계와 제 식구 감싸기로는 더 이상 체육계 비리를 막을 수 없다”며, “이제는 외부 기관이 직접 징계 권한을 행사해 공정성을 보장하고, 피해자 보호와 체육계의 투명성을 강화해야 한다”고 강조했다.
그러면서 “이번 법안이 통과된다면 체육계가 비리와 인권침해를 덮지 못하고, 국민 눈높이에 맞는 징계와 책임이 이뤄질 것”이라고 기대감을 표했다.
이번에 진종오 의원이 대표발의한 개정안에는 김용태, 이인선, 이만희, 고동진, 이종배, 서천호, 김승수, 신동욱, 김소희, 박수민 의원이 발의에 참여했다.
